Select Board:
Chairman Paul Trova, Bruce Marshall, Kathy Cormier.
Board & Public Attendees:
John Adams, Russ Parks, Mike Frederick, Phil Daignault, Barb Simken, Brian Hart, Larry Turner.
At 7:30 PM Selectman Trova opened the Select Board’s meeting.
The Pledge of Allegiance was recited.
Selectman Marshall made a motion to accept the prior meeting minutes. Board Member Cormier seconded. All were in favor.
The Select Board has met in public to review and approve correspondence and warrants presented to them.
Old Business:
Selectman Trova wanted to follow up on some of the issues that had come up in the prior Select Board Meeting:
• Maureen’s resignation-last day Oct 2, 2009-complete
• Post an ad for the Treasurer’s position-complete
• OTHCC work day will be on September 19th, 2009 at 10am-updates, Kathy-complete
• OTHCC Lease-complete
• OTH – add paving to capital plan. -complete
• Town of Windsor letter-complete
• Tax rate has been certified by Bureau of Accounts-complete
• Camp Romaca pumps
• Broadview
• Ask Pete to have our new employee, Gary Turner, clean all the town’s boilers.
• Multi-department meeting with Town Council on 9/23 at 7:00pm. -complete
• Adjust Ray Huntoon’s back pay. -complete
• Authorized payment to Tom Mathews not Matt Drosehn. -complete
The floor was open for discussion.
The Select Board has been asked by Pete Gallant to accept the lowest bid that has been submitted for the paving job at tonight’s meeting. The bids were opened and read aloud.

Selectman Marshall motioned to accept the bid that had been submitted by the lowest bidder, W.E. Williams contingent upon the OK from the Road Boss, Pete Gallant. Select Board Member Cormier seconded, all were in favor.
The Select Board announced that a stained glass fixture has been donated by the local artist that owns Box Car Galleries. The Select Board would like to thank her for the generous donation.
Selectman Trova has filed a disclosure notice with the Town Clerk with regards to his relation to Kim Trova. Selectman Trova excused himself from the room.
Kim Trova was present to request a business permit for the program that she will be running on behalf of ABC’s&123’s at the Old Town Hall Community Center. The State Inspector has approved the space pending the approval of the fire and building inspector. Selectman Marshall motioned to grant Kim Trova on behalf of ABC’s and 123’s a business certificate for the program that is slated to be run out of the Old Town Hall Community Center. Select Board member Cormier seconded, Board Members Marshall & Cormier were in favor. Board members Cormier & Marshall had also filed a disclosure form with regards to her relation to Paul Trova
Select Board member Cormier had mentioned that the lease agreement between the Town and ABC’s & 123’s has to be revised. Select Board member Cormier asked to have the Quiet possession section removed from the document. Selectman Marshall agreed.
Selectman Trova re-entered the meeting.
Selectman Trova announced that the Board had received a resignation from Herb Ferry from the Conservation Commission effective September 30th, 2009. The Select Board accepted his resignation with regret. Mike Frederick would like a copy of the resignation and would like to have the position posted in the Worth Noting section of the Berkshire Eagle.
Selectman Marshall motioned to approve the Hinsdale Dayz Special Liquor License for October 17th, 2009 from 11am-6 pm. Selectman Trova seconded, all were in favor.
The Select Board had received a number of resumes in regards to the Treasurers position. The Board would like interviews set up with the following applicants on October 14th, 2009 at 6 pm: Deb Cotter, Caryn Wendling, and Amy Lane.
Selectman Marshall motioned to appoint Deb Cotter as the interim Treasurer effective today. Selectman Trova seconded, all were in favor.
Selectman Trova had mentioned that a resident from Jordon Street would like a street light installed. Supposable it was approved by a Board prior. Select Board member Cormier motioned to petition WMECO and
Ask them to install a street light on Jordon Street. Selectman Marshall seconded, all were in favor.
Selectman Marshall mentioned that he would like to see concrete pads poured for the disposal bins and more land cleared behind the electronics bin area at the Transfer Station. He would also like a permanent stair structure for the bottles and can bin area. Mike Frederick asked to get the status of the monitoring wells before any pads are poured. Selectman Trova would also like to adjust the rates for the electronics bins.
Selectman Trova would like to have a ribbon cutting/open house at the Old Town Hall Community Center on October 17th, 2009.
Shaun Galliher had suggested that we get stated getting RFQ’s for the garage addition. Selectman Trova will get together with Pete with regards to the procedure for this.
Selectman Trova had spoken to a person from collections about the Broadview situation. She had threatened to send us to the credit bureau. They would like to settle with us but there is no firm number that they can give us.The Board is unanimous in there decision to not pay Broadview until they give proof of what the Town owes.
Selectman Trova would like to change the meeting start time from 7:30 pm to 7 pm going forward. The Select Board will vote on this at the next Select Board meeting.
Ed Goddard had mentioned that a Mr. Reinhart would like the Board of Health to look into a couple issues and they will look into that. Ed had also mentioned that the Boy Scouts had help with the stone cleaning and a lot had been accomplished and he would like the Select Board to send them a thank you letter. Ed had mentioned that there is a dilemma at the cemetery and the Board as the Cemetery Commissioners have to figure this out. Ed had explained to the Board that there are some plot issues in lot 11. Elmer Litchfield came to Ed because he wanted to bury his son Robert in the Tallburg lot. Ed asked if Elmer had permission for this and Elmer said yes. Ed received a call from the Tallburg family inquiring about this. The Tallburg sibling said that Elmer did not have permission to bury Robert there. The Select Board asked if there was written permission submitted to Ed, Ed replied “No”. Ed had taken Elmer’s word that he had permission to do this. Ed would like to establish plot ownership. The Kaley’s had to move a family member in the past due to a plot ownership discrepancy. The Select Board would like to have Elmer buy the plot where Robert lies. Barb Simken added that Elmer is very upset about the situation. Ed would appreciate the Boards assistance with this and going forward he will get approvals in writing.
Barb Simken had mentioned that there is not any money left in the legal fund and a reserve fund transfer will be needed. Select Board member Cormier will be present. Selectman Trova had also announced that the Town is being sued by former employees Karl Dewkett and Robert Dyer for wrongful termination.
John Adams had asked if Rodney was back on the force. The Select Board replied “No”.
Having no further business, the meeting adjourned at 9:00 pm.
